Hi, my name is John Kelly of the Kelly Law Team. I want to talk to you about back injuries in car accidents and what they’re worth in Phoenix.
The unique thing about back injuries in car accidents is that they’re 1) extremely common, 2) they often last a very long time, and 3) they’re hard to value because there’s a lot of different factors that go into it. So I want to talk to you about how it’s hard to put a value on it. Right off the bat, I’m going to tell you that some cases settle for much less than they should, and maybe they settle for 5,000, 10,000 when they should be settling for more like 20, 30, 40, hundreds of thousands of dollars. And there’s a whole spectrum of settlements that we see on back injuries.
Oftentimes people who injure their back, it takes a long time to heal. The back is very unique. It’s very susceptible to injury. It has the tendency to have pain that lasts a long time, and people will go to a primary care doctor or the hospital initially, and maybe they’ll get a little bit of treatment with a chiropractor or physical therapy, but they may still be dealing with that pain. And maybe it’s just low level pain, maybe it’s mid-level pain, but even if it’s low level pain, that’s pain that could last for months, it could last for years. It could be a decade before they feel completely better, and that’s just the nature of back injuries.
So when we’re dealing with valuing a back injury and how much it’s worth, we have to look at the long-term consequences because we only have one chance to settle the claim. And if we settle it with lingering back pain that may cause future medical expenses, future pain and suffering, and just the nature of the injury lasting years and years, we need to know that that dollar figure reflects that and makes it a fair compensation for that kind of thing.
So sometimes that means getting an ortho evaluation done by a doctor that can do the right scans and really give us an opinion about the healing process, and what maybe future interventions are going to be needed. There may be back injuries that need surgery in the future if treatment doesn’t work, if therapy doesn’t work.
Sometimes we’re kind of playing a wait-and-see game before we settle the case to understand whether that back injury is going to require surgery, or maybe we’re getting a future cost of the surgery estimate done to make sure that we understand what that looks like in the future.

  2. This is literally exactly what happened to me, but it was at the end of some congestion so i was already going pretty slow. Pumped the gas a little too long and stopped a few feet behind the car in front of me. about 3 seconds later I hear tire screeching and knew exactly what was about to happen.

    Truck slammed into me and shoved me into the car in front of me. My car was totaled and luckily the person in front of me only got a scratch. Cops tried to claim I hit the car in front of me before the trucks hit me before they learned dude was going about 60 in a 45 in congested traffic

    I used to love those. One set of paperwork, change a couple of details like names and the vehicle they were in, send off both sets.
    A full claim and I only had to do 3 minutes of work!

  4. I’ll never understand why if someone comes to a completely stop on the highway how it’s the person behind thems fault?

  5. Tip: if you ever have to come to a sudden stop behind a stopped vehicle, if there’s room then switch lanes asap and keep moving. It helps to avoid this exact situation

  7. I was this middle car once. A lady slammed on her brakes on 55mph highway. There was a firetruck coming to cross the highway but was a 1/2 mile away. Anyway, she slammed her brakes. We slammed ours. Her kids in the back seat were looking back at us and screaming. We stopped a couple feet from hitting them. Then got hit by a pickup at 30 to 40 mph and got sandwiched. Had some serious whiplash.

  8. I once saw a 6 car line of smashed cars. Everybody else stopped at the red and light and he was speeding and didn't. It was like an expensive version of dominos.

  10. This is why we need good public transit. I dont trust drivers to actually drive well on dangerously designed roads. So many crashes could be avoided, so many lives could be saved.

  11. Shouldnt they also be looking at why the first car jammed on brakes in the first place? If they were randomly brake checking others, shouldnt they be at least partially liable?

I've actually been told that if you avoid the accident but another vehicle pushes you into the vehicle in front of you, you're still liable for that accident because you should have stopped safely far enough back so that if you are hit from the rear you don't get the vehicle in front of you. I've been told that multiple times by various different people ranging from attorneys to insurance to police officers
