So if you are an adult, you either have to settle or bring a lawsuit within two years of the date of your accident. If you are a child or the parent of a child you do not need to bring a lawsuit till the child’s 18th birthday – plus two years. The only exception to that rule though would be there is some kind of injury caused by a government entity – it could be the state of California, could be your county, could be your city. If that’s the case, the same government entity statute of limitations would apply to the child as it would the adult, which is filing a claim within 6 months and once that claim is denied, filing a lawsuit within 6 months.
