My lawyer agreed to a settlement agreement workmans comp in Ca. with the wokman comp insurer. for lump sum on Jan 11th been 4 plus month and still havent recieved it. I dont understand the delay. I talked to the lawyer 5 weeks ago on April 11th. and he said 2 to 3 weeks. Been 5 weeks and still nothing. Is this normal. I thought once you agreed to settlement agreement shortly after the insurance company pays out what they agreed upon. Or is the delay in writing up the settlement agreement. I'm SO confused and stressed.

Only 1 WC per town so what happened to me first appointment at WC doctor was 2 months later ER hospital gave me only 3 days off work note I had to work with my torn ligaments for 2 months before I was able to see my the WC doctor than staid home 2 weeks and on Christmas management asked how I’m doing I didn’t want to lose job to be home on most busiest days In Christmas manager said bring doctor release note stupid me did it worked 2 days they fired me exactly on Christmas Day the December 25th !!! I made another appointment with WC doctor again it took 2 months for an appointment and WC insurance didn’t pay me for the 2 months until I saw the doctor to get the note even the doctor understood i was injured 4 months already so he gave me note from the 2 months prior and the WC insurance declined that ! Any physical therapy or MRI no response finally after 8 months got MRI confirmed its torn ligaments so 8 months ago had to be much worse because now I’m home no work but before employer made me work 2 plus months with injury where this stands . I feel there is a lot of done wrong because they know there is no attorney who takes WC in Hawaii also it’s billionaires club they have the best attorneys. Thank you for any help!

Thanks for your information. I had a slip and fall accident at a bank while delivering checks to the bank for my employer. I broke my wrist (ulna and radius), so I went to be the nearest ER. A few days later, I went into surgery, and now I'm getting physical therapy but I'm concern that my wrist will never be the same but at the same time I don't want to sue them because I think when we settled this injury and the partial disability will come up and hopefully then they can give me a reasonable offer. So far, my employer's insurance has paid for my sick leave and loss wages and medical bills. So we're on good terms. Plus I like my job so eventually I want to go back to work. Is the attorney necessary?
