In my opinion they were both in the wrong. 1.) He should have put his tools up when he wasn't using them at the moment. 2.) She should've listened to his advise about waiting there around 1:30pm. If I was her, I would have waited till I saw him, so he could walk me safely through the house. I mean what did she expect, after heiring someone who works with construction? What did she expect there to be? A fully cleaned house and no construction equipment with a job that usually takes 3 -4 months.

Everybody know that you don’t just walk into a construction site, that is why he had he blocked out and told her to meet him outside. If she had on regular shoes she wouldn’t of stubbed her toe which causes her to get shot in the head with the nail gun!!!
