Hi, my name is John Kelly, and I’m a car accident lawyer in Phoenix, Arizona. I want to talk to you about what happens when multiple people are in a car and whether everyone can get a full settlement if there are multiple people in that vehicle. One of the things that you’re going to look at is if you have other people in your car and you’re all trying to pursue the at fault party that hit you guys. So say it they ran a red light and crashed into your vehicle. And there’s four or five people in the car. Everyone is going to be making a claim against that one third party at fault. And the question becomes are multiple people going to be able to get fully compensated, especially if there’s limited policy that we’re going after. So anytime that we make a claim, we have to identify the individual that caused the accident.

And we look at what insurance they might have. But what people don’t realize is even if there’s a policy limit and in Arizona, the minimum policy is 25,000 per person, 50,000 per multiple parties. Right now that’s the policy minimums are supposed to be. Therefore, multiple parties making a claim against one party can only get 50,000 total. But what a lot of people aren’t aware of is that even though they may have to ration that 50,000, the passengers can go back and the driver on their own insurance policy and make an underinsured motorist claim. And the way that they do that is once they resolve the claim with a person that was at fault and get their money, they can turn around and make a claim with their own insurance company and say, I want to be compensated for whatever damages the third party was unable to cover for me because there was multiple claims. There wasn’t enough money to cover everyone.

And most people have paid for underinsured motorist coverage in their auto policy. So even if you’re a passenger, you can make an underinsured claim on your own policy. And that’s how you can oftentimes get your full compensation even though there is limited funds from the person that injured you.
